1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website and scanning services ("Service") provided by Scanitex ("Company", "We", "Us", "Our"). Please read these Terms carefully. By registering, accessing, or using the Service, you acknowledge that you have read, understood, and agree to comply with these Terms, our Privacy Policy, and any other applicable policies and agreements. If you do not agree to these Terms, you are not authorized to use the Service.

The terms "User", "You", "Your" refer to the individual or legal entity using the Service.

2. Service Description

The Scanitex Service is a professional platform for security auditing and infrastructure monitoring. The Service is designed to identify open ports and active network services on IP addresses or IP address ranges specified by the User ("Target Systems"). All data collected by the Service is publicly available and obtained from publicly accessible sources through standard network requests.

IMPORTANT: The Service is not intended for penetration testing, security vulnerability assessment, or any other actions that could be considered unauthorized access or hacking attempts. The Service is a tool for gathering information from open sources for security auditing and infrastructure control purposes.

3. Permitted Use and Purposes

Use of the Scanitex Service is permitted exclusively for the following purposes:

  • Security Auditing: Regular checking of your own infrastructure to identify unauthorized services and monitor network changes.
  • Infrastructure Monitoring: Tracking the status of network services and devices in corporate environments.
  • Asset Inventory: Creating and maintaining an up-to-date map of network services and devices.
  • Scanning Own Systems: Checking the configuration of User's own networks and servers.
  • Scanning with Explicit Permission: Scanning Target Systems owned by third parties only when the User has prior, explicit, and documented written permission from the legal owner or authorized representative of those Target Systems. A copy of such permission must be provided to the Company upon request.
  • Educational Purposes: Learning network protocols and network principles within educational programs.
4. Prohibited Use

Users are strictly prohibited from using the Service for the following purposes:

  • Any actions that violate applicable laws of the User's jurisdiction, Target System's jurisdiction, or international law.
  • Scanning any Target Systems without explicit prior written permission from their legal owner.
  • Attempts to gain unauthorized access to computer systems, networks, or data.
  • Actions aimed at disrupting normal operation, disabling, overloading, or otherwise harming Target Systems, networks, or infrastructure (e.g., DoS/DDoS attacks).
  • Collecting or attempting to collect personal data, confidential information, or trade secrets without legal basis.
  • Using the Service for spam distribution, malware distribution, or phishing attacks.
  • Any actions that could be considered aggressive, hostile, or damaging to the reputation of Target System owners.
  • Bypassing or attempting to bypass any security measures established by the Company or third parties.
  • Reselling, sublicensing, or other commercial use of the Service or data obtained through it without written permission from the Company.
5. Risk Acknowledgment and User Consent

The User understands, acknowledges, and agrees to the following:

  • Network scanning, even for the purpose of identifying open ports, may by its nature be perceived by Target System owners as an attempt at unauthorized access or hostile activity.
  • Scanning may generate significant network traffic and log entries on Target Systems.
  • In rare cases, incorrectly configured or unstable Target Systems may experience operational failures or performance degradation as a result of scanning.
  • The User bears full and exclusive responsibility for selecting Target Systems for scanning and for obtaining all necessary permissions from their owners.
  • Scanitex Company provides a tool, and the User is responsible for its lawful and ethical use.

By continuing to use the Service, the User confirms their informed consent to the above risks and assumes full responsibility for possible consequences of their actions when using the Service.

6. User Responsibility and Indemnification

The User bears full responsibility for compliance with these Terms and all applicable laws and regulations when using the Service. The User agrees to use the Service in a manner that does not violate the rights and legitimate interests of third parties.

The User agrees to defend, indemnify, and hold harmless Scanitex Company, its officers, directors, employees, and agents from any claims, lawsuits, demands, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or in connection with:

  • (i) User's use of the Service in violation of these Terms;
  • (ii) User's violation of any applicable law or third-party rights;
  • (iii) any complaints or actions by third parties related to User's scanning of their systems.

All abuse reports regarding misuse of the Service are investigated by our team. The Company reserves the right to suspend or terminate User access to the Service and cooperate with law enforcement agencies in case of violations.

7. Company Liability Limitation

The Service is provided "as is" and "as available" without any express or implied warranties. Scanitex Company does not guarantee that the Service will operate uninterrupted, error-free, or that all discovered data will be accurate and complete. Use of any information or materials obtained through the Service is at the User's own risk.

To the maximum extent permitted by applicable law, Scanitex Company, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including but not limited to lost profits, data loss, business reputation damage, equipment or network failures) arising from or in connection with the use or inability to use the Service, even if the Company was notified of the possibility of such damages. This liability limitation applies regardless of the legal theory on which the claim is based (contract, tort, negligence, or otherwise).

The User is solely responsible for ensuring that any products, services, or information available through this Service meet their specific requirements and that their use is lawful.

8. Age Restrictions

To use the Service and purchase any services, the User must be at least 18 years old or have reached the age of majority under the laws of their jurisdiction.

9. Refunds

The service is considered fully provided from the moment the User is granted access to scanning results. Refunds are possible in case of complete Service downtime (unavailability for use) due to Company fault for at least three consecutive days. The refund amount is calculated proportionally to the unused time of the paid service or in full if the service was not provided at all. Refund requests are considered on a case-by-case basis.

10. Changes to Terms

We reserve the right to change, modify, add, or remove parts of these Terms at any time at our sole discretion. We will notify Users of material changes by posting updated Terms on the website and/or via email. Continued use of the Service after changes are made constitutes your unconditional acceptance of the updated Terms.

11. Intellectual Property

All content presented on the Service website, including text, graphics, logos, software, and trademarks, is the property of Scanitex Company or its licensors and is protected by copyright and intellectual property laws. No intellectual property rights of the Company are granted to the User, except for the limited right to use the Service in accordance with these Terms.

12. Applicable Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction. All disputes arising from or in connection with these Terms shall be resolved in the courts of the specified jurisdiction.

13. Termination

Scanitex Company reserves the right to suspend or terminate User access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination of access, the User must immediately cease all use of the Service.

14. Severability

If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified and interpreted to best achieve the objectives of the original provision to the maximum extent permitted by law, and the remaining provisions of these Terms shall remain in full force and effect.
